Mediation

Mediation has been defined as a flexible process conducted confidentially during which a neutral person actively assists parties in working towards a negotiated settlement of a dispute or difference with the parties in ultimate control of the decision to settle and the terms of resolution.

Benefits of Mediation

  • Successful – Over 70% of cases referred to mediation settle
  • Quick – Most mediations are arranged within a few weeks (and can be arranged even more quickly) and the formal mediating session usually lasts for one day only
  • Cost-Effective – Compared with litigation and arbitration, mediation is a less expensive way of resolving disputes
  • Control – It gives parties control over the process and the outcome
  • Mediation can run alongside litigation  - or it can be put on hold while you mediate
  • Confidential – Mediation is confidential and “without prejudice”, so that nothing said in the mediation is admissible in legal proceedings
  • Friendlier – Mediation can maintain business relationships far more effectively than adversarial processes which can drive parties further apart
  • Varied – A wide variety of settlement options can be achieved in mediation including some which would be outside a Court’s power to order
  • Informal and Flexible – the process to suit client’s needs
